Asset Forfeiture & Confiscation

LBC v UA – 2019

Edward Duncan Smith was instructed in this case which involved a multi-handed POCA confiscation proceedings in which the prosecuting Borough Council alleged over £800,000 of criminal benefit by the client.  A settlement was ultimately negotiated in the sum of just £150,000.

Luton Borough Council v NUR (Luton Crown Court) – 2018-19

Vakas Hussain was instructed in this case where the defendant pleaded guilty to fraudulent trading under s.993 of the Companies Act 2006 following which Confiscation proceedings were commenced. Initially, the prosecution arrived at a ‘benefit figure’ in excess of £600,000. However, in the end the benefit figure was negotiated down to £86,062.60 and a Confiscation Order was made in the sum of £2,244.20.

R v BS – 2019

Kate Nutter was junior in this case. Following a conviction for offences of money laundering; BS is currently subject to on-going confiscation proceedings.

PBC v MM – 2018

Edward Duncan Smith was instructed in a multi-handed POCA confiscation proceedings involving complex legal arguments about the equitable interest in a property.

R v R – Folkestone Magistrates’ Court – 2018-19

Tom Worden represented a client in a complex enforcement proceedings with available amount of £3.3m (including a tainted gift and hidden assets) and a default term of eight years.
